LSK Boss Erick Theuri Calls Lawyers to Protests
The Law Society of Kenya (LSK) will on Friday 12th January 2024 hold countrywide peaceful protests against President William Ruto’s remarks on Judiciary on the New Year’s Eve.
In a memo sent to Advocates in Kenya, LSK boss Erick Theuri has urged all the legal practitioners to turn up in large numbers to stand in solidarity with the Judiciary which he says is under threat following the Head of State’s remarks.
Late last year, while making his State of Nation Address, the President attacked judiciary, claiming it is full of bribery and corruption, for what he terms as making decisions that impedes the government national agenda. This comes after the High Court of Kenya at Milimani (Nairobi) had ruled that the government’s bill to have salaries deducted for house levy to be unconstitutional.
Earlier in 2023, flamboyant city activist Senator Okiya Omtata filed a case challenging the government’s Financial Bill 2023, claiming the government was extorting the citizens by imposing too many taxes, housing levy being one of them. Housing levy was aimed by the government towards ensuring affordable houses are built in Kenya in a span of 10 years.
The court ruled against the government, causing the President to throw barbs at the judicial officers. Prior to that, the courts had also ruled against appointment of fifty (50) Cabinet Administrative Secretaries (CAS), directing that the reasonable number was half the appointed ones.
The president’s new years’ eve address has drawn concerns from within and outside the country, the underlying message being that the President should respect the Judiciary and uphold the rule of law. Ruto also directed his cabinet secretaries to ignore court decisions that are ‘against government development agenda’.
President Ruto’s attacks on judiciary are ironic since his win in the 2022 presidential elections was confirmed by the courts. Critics put it that if the President doesn’t want to respect the courts, he should as well resign since the same courts upheld his win.
He further directed all lawyers and legal practitioners to put on yellow ribbons beginning next week to show solidarity with the justice system.
A runaway Kenyan lawyer Miguna Miguna, who is based in Canada has advised the president to adopt sound policies instead of threatening the courts.
